Dear Rin,

It's another happy Friday from RACS World Headquarters!
Yet another slow news week in the Anime world, but September usually is anyway -
and it's not like there isn't enough going on in the 'real' world to make up for
it. The news about the economy has been pretty negative lately (I mean, even more
than usual), and I can't say my experiences through our businesses don't agree with
much of what's being said.
Like many of you, all of us here at RACS have been struggling going on three or
four years now - not to succeed or grow - but just to keep our dreams alive, despite
a dismal economy and even the consternation of a certain segment of the fan community.
So I just want to, once again, personally thank all of you for your support and
notes of encouragement over the last few months. We would not be able to continue
to do what we do without your support, and all of us here at RACS appreciate it
very much. Very much indeed.

No real updates this week, however, Funi did send out a bulletin letting us know
that they have canceled the December release of one of their live action titles:

"Big Tits Zombie - Live Action Movie - Blu-ray/DVD Combo (FN-09823) has been removed
from the schedule. Its original street date was 12/20/2011."

Damn, I mean, who wasn't looking forward to that one?! -_^

Speaking of Funi, we got a shipment of new titles in from them earlier this week,
and as it turned out the shipping carton that contained the new Witchblade Complete
Collection DVD Boxed Set (Eps #1-24 ) (Classic Collection) [http://r20.rs6.net/tn.jsp?llr=hjzho5bab&et=1107778887083&s=17502&e=001sMy6hUYkZdHs8u6JC0Of35QKIdZ845VU-Jta3t5gxH_Q_p-AmjsyjCdRSUDrqOa-T_7sZ0iRLQLIFNQKkxcdpi-43nlvX0mYrXs_M_oInRwA5jjjwyTnYr-JsmbTJk_n4vdrangPWyNDqw-d3WkJew==]
got soaking wet in transit. This sorta thing happens from time to time, and is why
we haven't posted it as being in stock yet. We've returned all the damaged copies
to Funi and are just waiting for the (hopefully dry) replacements to arrive. They
should be here anytime now.

Modern Magic Made Simple: Life hasn't been fair to Koyomi Morishita. Even though
she's in high school, she's so short that everyone assumes she's still in grade
school. The boys and girls in her school tease her mercilessly, and she's not
exactly graceful either. On the other hand, she's still better off than Yumiko,
who has a magician trying to kill her. Or at least Koyomi WAS until their paths
crossed! Fortunately, salvation arrives in the form of master mage and graduate
student Misa Anehara, who agrees to take Koyomi under her wing in learning the
new style of magic, which breaks enchantment down into sequences of code. That'll
be quite a task, given that so far Koyomi's talent seems to consist of making washbasins
randomly fall out of the sky. But if it was easy, it wouldn't be magic, would it?

State of the Industry - Pot Sues Kettle

I was perusing the news blurbs over on the Anime economatrix this week, when I came
across this little gem:

"Crunchyroll and TV Tokyo have issued a lawsuit against 13 YouTube uploaders for
allegedly illegal distribution of anime episodes, according to a copyright infringement
complaint filed on May 11 and served between July and September. Crunchyroll and
TV Tokyo are seeking reparation for "great and irreparable injury that cannot fully
be compensated or measured in money" because of the defendants' allegedly unauthorized
copying, uploading, and distributing via YouTube of multiple Naruto, Naruto Shippuden,
and Bleach episodes.

Based on their YouTube subscriber information, the defendants reside in the United
States, Japan, Canada, Denmark, and Hungary. Crunchyroll maintains its main offices
in California (as does YouTube), so the suit was filed as a U.S. copyright violation
in the Northern District Court of California. For the purposes of the lawsuit, TV
Tokyo is giving Crunchyroll legal permission to act on its behalf in order to "permanently
remove the illegal uploads of infringing parties from file-sharing services and
to obtain legal relief against infringers."
I just find it a bit entertaining as, before they went legit, Crunchyroll got it's
start and built it's audience streaming unlicensed fansubs captured from torrents.
A little history:
"Launched in the summer of 2006, Crunchyroll is a video-streaming site run by Crunchyroll,
Inc. that originally grew by serving illegal (unlicensed) content, namely Japanese
Animation (anime). The site generated revenue by soliciting donations and through
advertising. After failing to be bought out by Viacom in 2007, Crunchyroll secured
venture capital funding to the tune of $4 million through Venrock."

'Did you ever feel a cognitive disconnect making money - regardless of what that
money was used for - by providing illegal streams of the artists' work, without
a dime of it going back to the artists themselves? You weren't subtitling them
yourselves, either, just using external fansubs, and making money by streaming them.
Did that ever bother you? Did you ever stop and think "what are we doing?'
Vu Nguyen: I wouldn't say that, but a lot of people don't realize how much work
and money it takes to keep a website running. All of the donations went into operating
expenses. We put in countless hours every week after work and school to make it
a good site. We weren't trying to make a profit, but just keep the site running.
We believe the same thing fansubbers do, that by growing the popularity of anime,
we are growing the fanbase and the industry. I can't comment directly on it, but
I can say how the anime and fansub community even began.
'I don't see how that's relevant...'
Vu Nguyen: It's a little bit like... fans taking matters into their own hands. Fansubbers
consider themselves fans.
'But they weren't charging people... it's against the most basic "code of ethics",
if you will, that fansubbers claim to follow. Even speed subbers who do licensed
titles find it wrong. So I don't see how you could equate fansubbing with what
you've done here.'
Vu Nguyen: Again, we weren't trying to profit but cover costs. It's similar to how
fansubbers used to charge for the price of the VHS tape and shipping to distribute
their work.
'But you didn't fansub anything yourself - you're a third party, providing these
streams illegally with no permission from literally anyone involved in their creation.
Not the production companies, not the artists, not even the fansubbers. How do you
justify that?'
Vu Nguyen: The reason fansubbers do their work is because they want it to be distributed
and they want people to see their work and we feel we've done so without trying
to profit. There have been a few fansubbers who didn't mind what we were doing.
Did you ever attempt to reach out to the fansubbers or the content providers before
you started hosting their material? Asking permission beforehand and letting them
know exactly what you were doing, how much money was changing hands, before hosting
these fansubs?
Vu Nguyen: 'We didn't.'
Indeed. It's pretty clear that these guys got into this to make a lot of money,
and really didn't care how they did it. Of course, as soon as they got the angel
funding from Venrock (and started working up SEC filings so they could privately
sell more shares) they had to go legit, but they shamelessly built their original
audience and 'brand' on unlicensed content. Recently they have made broad claims
about how their service has helped put a dent in torrent downloading, but Crunchyroll
was never about reducing piracy (nor has it despite of their claims) - it was
always about the founders building wealth by whatever means necessary. When piracy
was to their financial advantage, they embraced it. Now that it isn't, they attack
it. If that isn't pure red blooded Corporatism, I don't know what is. I mean,
that's the way big banks and multinational corporations operate. You see, in business
when there are millions of dollars to be made, rules are for the little people.So
let's not forget that Kun Gao, Vu Nguyen, Sanha Han, Brandon Ooi, James Lin and
many others have gotten filthy rich off an enterprise that they started deep in
the shylocks.
An honest buck is so hard to make...
Just something to think about the next time you are watching Anime there. I'm sure
there will be outrage from the fan community over their persecution of YouTube users,
and if not, I just hope the irony does not escape you. :-)

is shipping (in Japan) on Friday, and the first film in the three-part retelling
of the Golden Age arc of Kentaro Miura's manga will open in Japan next January.
Digital Manga Publishing and Dark Horse are publishing the 35th manga, which is
supposed to begin shipping to retailers soon. We'll have it posted for ordering
as soon as they arrive.
Aniplex announced this week that it will stream the Fate/Zero television anime series,
subtitled in eight languages, worldwide via the Niconico Live and Niconico Channel

- Guardian of the Spirit, has begun production on a new anime feature. He will personally
reveal his latest project at an announcement event at Tokyo's Shinjuku Wald 9 theater
on October 4.
The Animation Market Analysis Project of Japan's Media Development Research Institute
(MDRI) reported on September 9 that the market for domestic and foreign animation
in Japan grew 5.8% to 229.0 billion yen (about US$2.55 billion) in 2010. This was
the second annual increase in a row, after the 1.6% increase the previous year.
These figures cover both Japanese animated works and foreign animated works that
were sold or distributed within Japan. The results include theatrical films, home
video sales and rentals, television animation, and online distribution via computers,
Internet Protocol Television, and mobile phones. MRI noted that the data reflects
the significant contributions that hit animated films have made to the overall market
in recent years. Titles such as the Japanese anime film Arrietty (9.25 billion yen)
and the American animated film Toy Story 3 (10.8 billion yen) lifted the overall
box office total higher in 2010. By contrast, the number of animated television
works continued its general downward trend from its peak in 2006, as the over-the-air
television market overall grew smaller.
The Minnesota anime convention Anime Detour is currently hosting a donation drive

for voice actor Greg Ayres (Ouran High School Host Club's Kaoru Hitachiin, Sengoku
Basara's Kenshin Uesugi, Negima!'s Negi Springfield). Anime Detour notes on the
donation site that Ayres was the victim of an assault when he was younger that affected
his teeth, and his dental bridge has recently fallen out. Anime Detour also notes
that as a result Ayres cannot currently voice act. The donation site states that
Ayres will need a "complete rebuild of his dental bridge to fix the damage." Anime
Detour's goal for the drive is to raise US$10,000. Anime Twin Cities, Inc., Anime
Detour's parent company, will match donations for the first US$5,000 donated in
the drive. If the goal of US$10,000 is reached, Anime Detour stated it will donate
any excess donations to other anime community members in need.
And finally, Smile Company announced on Sunday that singer Elisa is putting her
music career on hold due to fatigue. According to the agency, exhaustion and fatigue
have been building for about half a year, so she is taking time off to take care
of her health. The concert scheduled for October 2 at the Tokyo Globe-za theater
has been cancelled, as well as other future concerts and events that have been scheduled.
Elisa's Twitter account will no longer be active.
Man, I envy her. Wish I could afford to do that. -_^
